The Trump administration is reportedly preparing comprehensive sanctions against the International Criminal Court (ICC), marking a significant escalation in its long-standing opposition to the global tribunal. Sources familiar with the matter indicated on Sunday that the announcement could come soon, potentially targeting the entire organisation. Washington’s disdain for the court stems from its efforts to compel the ICC to drop arrest warrants against Israeli leaders and a past investigation into American troops in Afghanistan. This move follows previous actions, including sanctions on individual ICC judges and prosecutors and a broader campaign to isolate the court.
These proposed entity-wide sanctions, if enacted by the US Treasury, would prohibit American citizens and companies from providing funds, goods, or services to the ICC without specific licensing. Banks, heavily reliant on access to the American financial system, are likely to over-comply with such restrictions, potentially crippling the court’s operations. The ICC’s registrar and president have previously warned that sanctions against the organisation could impede critical functions such as purchasing IT services and insurance, hiring investigators, and conducting everyday financial transactions, including payroll for its dozens of American employees.
The International Criminal Court was established in 2002 by the international community to prosecute war crimes, genocide, and crimes against humanity. It asserts jurisdiction only if a member state is unable or unwilling to prosecute such atrocities itself. The United States has never been a member of the court. While the exact timing remains unclear, officials cited by The Wall Street Journal suggested a decision could be finalised this week during the United Nations General Assembly meeting. President Trump’s renewed opposition aligns with a plan developed in November 2024, following the ICC’s issuance of an arrest warrant for Israeli Prime Minister Netanyahu.
