The Australian and International Pilots Association is appealing against Fair Work Australia’s decision to stop them from taking industrial action against Qantas Airways Limited (ASX:QAN).

The union says the only industrial action taken to date against the airline has been to wear red ties and make short announcements before takeoff. The pilots’ union is arguing that Qantas’ response to lockout staff was disproportionate.

The union’s solicitor says no passenger was delayed or flight cancelled and the wearing of red ties wasn’t having any impact on the economy.

In the 2011 financial year Qantas reported a net profit of $249 million.
