Cochlear receives decision in US patent lawsuit

Cochlear Limited (ASX:COH) has announced the US Court of Appeals has entered a decision in the appeal of the judgment in a patent infringement lawsuit made by two companies against Cochlear and its US subsidiary.

The appeal decision relates to an original jury finding that Cochlear had infringed four claims across two patents, and that the infringement was willful.

In April 2015 a Californian District Court Judge overturned three of the four patent claims and ruled the infringement was not willful.

Following appeals by all parties, the Court of Appeals has affirmed the judgment as to infringement and that of the invalidity of one patent.

It has reversed the judgment of invalidity as to one claim in the other patent.

Cochlear Limited reported a net profit of $188.9 million at 30 June 2016.
